Acceptance

These Terms of Service (“Terms”) govern your use of Backstage, a private booking-intelligence tool operated by Invision Designs (“we,” “us,” or “the operator”). By signing in to Backstage with a Google or Microsoft account, you agree to these Terms and to the Privacy Policy. If you do not agree, do not sign in.

Access to Backstage is by invitation only and is granted at the operator's sole discretion. The operator may revoke access at any time without notice.

What Backstage is

Backstage monitors publicly available event listings, scores them for coverage opportunity using AI, and helps you draft outreach emails to event organizers. Outreach is sent from your own Gmail or Outlook account using OAuth-delegated access; Backstage does not operate its own mail server and does not send email on its own behalf.

Your responsibilities

  • You are the sender. Every email that leaves Backstage is sent from your own email account. You are responsible for its content, accuracy, and compliance with applicable law.
  • Review before sending. AI-drafted outreach is a starting point, not a finished product. Review every draft before you click Send. The operator is not responsible for the content of drafts you choose to send.
  • Comply with anti-spam law. Outreach sent through Backstage is commercial-leaning email. You agree to comply with the U.S. CAN-SPAM Act (15 U.S.C. § 7701 et seq.) and any other anti-spam law applicable where you or your recipient resides, including:
    • Using accurate, non-deceptive subject lines and from/reply-to information.
    • Including a clear opt-out mechanism in every commercial email.
    • Honoring opt-out requests promptly (within 10 business days under CAN-SPAM).
    • Including a valid physical postal address in every commercial email.
    • Not sending email to recipients who have asked you to stop.
    Backstage provides a profile signature field to help you meet the postal-address and opt-out requirements. Filling it in is your responsibility.
  • Account security. Keep your Google / Microsoft credentials secure. You are responsible for all activity that occurs under your account.
  • Accurate information. Information you enter into your profile, ratings, and notes should be truthful. Defamatory, harassing, or misleading content is prohibited.

Acceptable use

You agree NOT to use Backstage to:

  • Send spam, bulk unsolicited email, phishing, or fraudulent outreach.
  • Impersonate any person or organization, or misrepresent your affiliation with one.
  • Harass, threaten, defame, or harm any individual.
  • Scrape, copy, or redistribute the database of listings outside the app, or use it for any purpose other than your own professional outreach.
  • Reverse-engineer, decompile, or attempt to bypass authentication, rate limits, or other technical controls.
  • Use the service in a manner that violates the terms of service of Google, Microsoft, Anthropic, Supabase, or any other sub-processor.
  • Use the service to violate any law, regulation, or third-party right.

The operator may suspend or terminate your access at any time if it believes, in its sole discretion, that you have violated these Terms.

AI-generated content disclaimer

Backstage uses third-party AI models (currently Anthropic's Claude) to score listings and draft outreach. AI output can be inaccurate, incomplete, or inappropriate for the context. You acknowledge that:

  • AI-generated drafts are suggestions, not finished work. You must review every draft before sending.
  • Scores (bookability, worth-it, success-rate) are heuristic estimates and not guarantees of any outcome.
  • Field extraction (artist names, venue, date, pay) may be wrong. Verify against the original listing before relying on it.
  • The operator is not responsible for any consequences of your use of AI-generated content.

Scraped content

Backstage indexes event listings from publicly available sources (venue websites, edmtrain, Songkick, Ticketmaster). The operator does not claim ownership of the underlying event information and respects publishers' robots.txt directives where they apply. If you operate a site that is being indexed and would like to be excluded, contact the operator.

You may use scraped listings inside Backstage for your own professional outreach. You may not export, redistribute, or build derivative products from the listings database.

Intellectual property

The Backstage software, design, and trademarks are the property of Invision Designs. These Terms do not grant you any license to that intellectual property beyond the limited right to use the service.

Content you create inside Backstage (notes, drafts, ratings, profile data) remains yours. You grant the operator a non-exclusive license to store and process that content as needed to operate the service.

No warranty

Backstage is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability. The operator does not warrant that:

  • The service will be uninterrupted, secure, or error-free.
  • Scores or drafts will be accurate, useful, or produce any particular outcome.
  • Scraped listings will be complete, current, or correct.
  • Defects will be corrected within any specific timeframe.

Limitation of liability

To the maximum extent permitted by law, in no event shall the operator be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of Backstage, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if the operator has been advised of the possibility of such damages.

The operator's total cumulative liability for any claim arising out of or relating to these Terms or the service shall not exceed one hundred U.S. dollars ($100) or the amount you have paid the operator for the service in the preceding twelve months, whichever is greater. Because Backstage is currently provided at no charge, the cap is $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, the operator's liability is limited to the smallest extent permitted by law.

Indemnification

You agree to indemnify and hold harmless Invision Designs and its affiliates from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to (a) your use of the service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) the content of any email you send through the service.

Termination

You may stop using Backstage at any time by signing out. You may request deletion of your account and associated data by contacting the operator (see “Contact” in the Privacy Policy).

The operator may suspend or terminate your access at any time, with or without cause, with or without notice. On termination, the Acceptable Use, No Warranty, Limitation of Liability, Indemnification, and Governing Law sections survive.

Governing law and disputes

These Terms are governed by the laws of the State of Ohio, U.S., without regard to its conflict-of-law principles. Any dispute arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Franklin County, Ohio, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

The operator may update these Terms from time to time. The “last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated through the app or via the email associated with your account. Continued use after a revision constitutes acceptance of the revised Terms.
